Subject: Support AB 3


Dear Committee Staff,

​Our family is writing to you today in support of AB 3.  As identified in the state direct audit completed on October 24, 2024, the Department of Health Care Services repeatedly licenses clusters of residential recovery facilities, including those of the same operator.  According to the courts, the purpose of group homes is to enable the least institutional settings so that occupants can integrate with and engage with the community.  AB 3 would remove the privilege of having additional facilities operated by the same operator in close proximity declared a "residential use" of property because the operator is effectively creating an institutional setting of similar group homes within a given neighborhood, which the courts consider discriminatory.  The DOJ and HUD concur.   We do, too. Please count as supporting AB 3.
